ON recently got sued & agreed to a settlement. It's a bullshit lawsuit that was nothing more than a play on words, but regardless they admitted no fault but agreed to a 1.4 m settlement. I love their company & their product, but I qualify for some $ under the settlement. So my question is, if I take this money am I taking it from the company OR have they already paid out the settlement & I'd just be taking a piece of the pie?
I mean if they have already dished out the money & I'm just taking a chunk. Cool. But if they get the money back that isn't claimed or something, I wouldn't want to take it from them.

If so, it depends on the settlement agreement whther they get the money, the lawyers get the money, or the insurer keeps the money (probably the latter).
I opt out of class aciton settlements because that part of the legal system disgusts me.

Did you receive any information on the lawsuit prior to this ruling? Did you accept/sign on as part of the lawsuit prior to this ruling? I thought that as a potential 'victim' that you had to be notified and accept part of this lawsuit prior to it beginning to receive damages. Damages which would have been stated as an average per complainant.
Anyway with a 1.4 million settlement everyone who signed on board will get their check for about $5.00. Is it worth the effort?

$48 actually, and it would have just bought me a new tub of protein is all. My quick reading of the settlement (http://www.enzymesettlement.com/Documen ... eement.pdf) seems to indicate that they're up for a minimum of a million, and above that it depends on how many people take part. That means your $48 would come directly from them assuming the minimum is crossed.
Someone else may have a better reading than I do though.

And, to be completely honest, if I were ON, I'd be thanking my lucky stars it was just a civil action suit, and the FDA didn't choose to become involved. The claim they made without evidence seems awful close to heading into medicinal territory; There's a reason the quack miranda is on pretty much every supplement you can buy.
