Apple v Samsung

Post by Ddrak »

This result shits me. The only thing it's going to do is encourage the companies to sue each other over retarded patents and stifle innovation and development in the mobile industry.

I do have to wonder if the jury got together and said "this is going to get appealed no matter what we do, let's just make it sensational".

After reading what the foreman had to say, Samsung should just go for a flat out mistrial. Juries are not supposed to be sending messages by bumping up damages, and they were instructed specifically not to do that (if I recall).

The jury apparently decided Apple owned anything with a flat screen and a bezel. Seriously? Fuck that shit - Does that mean every LCD monitor and TV are now owned by Apple too?

This crap makes me mad. Jury trials for non-criminal matters are just bullshit. Get professional jurors or just have the judges do it.

It makes me mad too. We are nerds, and this could have a (more) chilling effect (than already) on technical innovation. There's not much true innovation these days anyway. You have these huge patent trolls choking out anything that makes a buck. As much as the whole copyright system needs a total overhaul for the tech era, patents need it much more.

Neither patents nor copyrights are functioning anywhere near how they were originally intended to function.

Of course Samsung will win this on appeal. And none of this shit makes me want to buy any Apple product. I will continue to buy Samsung products because they are an awesome company.

The funny thing - the only device that had an actual injunction on it (Galaxy Tab 10.1) was one that was cleared as not infringing by the jury. Samsung is now making sure that gets opened up again (and you can bet they are taking Apple's bond money as well).

Also note that the jury was awarding damages for things they found non-infringing. Paying attention? NOT!

Next, they're asking Judge Koh for a straight up mistrial which they might get, but unlikely. I think Koh is sick of all this and wants it to go away.
So then they get to appeal Koh's refusal for a mistrial. That can possibly go all the way to the USSC as to the question of how carefully juries need to follow instructions, and deliver a well reasoned verdict.
Once that's through, they can then start appealing the actual verdict. Again all the way to the USSC for patent validity ("UI" patents have been there before).
So, that will be 6 or more years down the track. With anyone's guess what the results will be.

Funny part? Apparently the take-home message for mom-and-pop is that Samsung is equivalent to Apple...

Agreed. By contending with Samsung, in a way they've elevated them. It's certainly giving Samsung more street cred too.
