I think we're basically agreed that you could make a highly technical criminal case out of it but no one's really that interested and a civil case would have a much higher chance of smacking the ex-cop around.
The fun thing about wire fraud and mail fraud is the FBI can use them for just about anything they want.

Couldn't we just work this backward? Basketball goal and tether pole were stolen. After the theft, the goal was given to the thieves, possibly negating that one charge.
Next decide who is responsible for the theft. The people picking up the items did not obtain permission to get them, though they thought they had permission due to the list the cop posted. I think fraud charges could be made because someone was profiting off the lie told by the cop. I don't think that it matters that the cop was not the one benefiting. If you commit fraud so your kids or friends profit, I would think it would still be fraud.
How about conspiracy to commit a theft? The cop attempted to recruit (and was successful) people to commit a theft. I don't even know if this law is on the books, but hey it sounds good.
Other possibilities might be accessory to theft. I like the wire fraud stuff, too.
