And here is the problem with your arguement. Google is taking advertizements.....but they are not required to initiate the downloads, unlike:
BitTorrent tracker is a server which assists in the communication between peers using the BitTorrent protocol. It is also, in the absence of extensions to the original protocol, the only major critical point, as clients are required to communicate with the tracker to initiate downloads. Clients that have already begun downloading also communicate with the tracker periodically to negotiate with newer peers and provide statistics; however, after the initial reception of peer data, peer communication can continue without a tracker.
The tracker they opperate is not just advertizing links......it faccilitates the transactions.

That does go against them, sure, but it's circumstantial not factual.

TPB doesn't operate the trackers typically (most of their stuff is linked to Demonoid's tracker among dozens of others). They literally serve up the torrent files (provided by users) which are simply links to the trackers which in turn are links to the people that actually have the content.
In an case, saying you "need" a tracker is like saying you "need" Google to download stuff. It just facilitates finding the sites (peers) that actually have it but you can definitely download from the peers without a tracker in between as anyone who's used DHT can tell you.
As far as I can tell, the case isn't about the tracker anyway, it's about the fact they have a search engine for .torrent files, which are 2 steps removed from the actual content. I'm not condoning what they do, but I'm saying they have a decent chance in court where there's no law regarding linked content.
