The requests for pardons last minute pardons are starting to fly in. Any guesses as to who gets off the hook and who is left to hang out and dry?

I'm thinking Scooter Libbly gets the other half of his pardon. And there will be preemptive pardons for Erik Prince, Alberto Gonzales, Dick Cheney, and just about everyone accused of torture or other human rights violations related to the GWOT.

Randy "Duke" Cunningham accepted hookers as part of his corruption. I don't think he or anyone other GOP operative convicted of crimes of a sexual nature are going to get lucky.

You can't do preemptive pardons. You can try, but they don't actually pardon anything.

Maybe in Australia. But in the US It's done. President Andrew Johnson pardoned the soldiers of the confederacy, and Jimmy Carter pardoned Vietnam draft resisters. Those were blanket pardons of an entire category of people who had not yet been indited for any crime. President Gerald Ford Preemptively pardoned Richard Nixon.

Nobody has the power to pardon anyone in Australia (at least that I'm aware of) without actually going through legislation, so the point's kinda moot.

I just remember reading a bunch of legal opinions on preemptive pardoning that said it really didn't have any power aside from a chilling effect on the actual prosecution. Hence I said he could *try* but it wouldn't actually have meaning if a case ever went to court.

If that preemptive pardon is challended it will go all the way up to the supreme court. That court tends to rule for bush these days.
