New California law in 2008
I was looking through new laws or codes which will go into effect in California in 2008 and came across this.
HS 12814.6-This code makes it an infraction for a person to smoke a cigarette, pipe, or cigar in a motor vehicle when a minor is present in the vehicle. The law applies whether the vehicle is at rest or in motion. It is a secondary enforcement offense and is punishable by a fine not exceeding $100.00.
A secondary enforcement effect means it cannot be used to stop a vehicle, but can be written if the vehicle was stopped for some other offense such as speeding, etc.
Personally I like it. My parents smoked in the car when I was a wee lad, and I had no real choice in the matter but to put up with it.

Sure,
If I didnt smoke back when my kids were three to calm my nerves, I probably would have beat them.
The law is gay and its time they worry about more important things then smoking in a damn car.

California should just outlaw tobacco. I want to know if a minor is smoking in their car, are they infringing?

Its amazing whats legal and whats not. I agree, if smoknig isnt legal anymore there would be alot of issues cleared up . Yea I quit smoking 3 years ago on a whim and never looked back. But if I never started, then what? The argument goes in so many ways its not even funny

I'm cool with it. I wish other states would do this. Parents (from my limited suburban perspective) spend a lot of time driving their kids places. That's a lot of time a kid is couped up in a car with the stuff. Yea, the window is usually open, but it still trails into the car and that's such a small area. A parent really can't find time to at least go into another part of the house or step outside and do it? It has to be done in the confines of a car? On a different topic... Personally, I'm for making it illegal (fat chance) It's the main reason why I'm against legalizing marijuana for recreational uses... until we get rid of some of the current bad shit (smoking) that effects the people around the user rather than adding on more :\ and then maybe I'd reconsider.

One day I decided to just not smoke anymore. thats quitting on a whim. its not going to get hypnotised, or getting the patch, etc. its just tossing the pack into the can and sayin...no mo.

2nd hand smoke can cause a lot of sickness in young kids, I fully agree with this law.

Try not to conflate cigarette smoking with ganja. Nobody can smoke two packs a day of the 'ol yerba buena ansd still function. Its a self correcting problem. If you want to ban pot, you shuold also want to ban alcohol and caffeine related products. The arguments are similar in those instances (especially with the alcohol). If people are allowed to self-medicate with booze, why shouldn't they be allowed to self-medicate with weed?
Legalize it, tax it, and regulate it like any other impairing compound.

I don't see them as equals. But I'd rather work to get rid of the worse thing before adding more stuff into society. Prioritizing I guess?

What does one have to do with the other? Obviously you're aware that legislatures work on multitudes of bills at any given time. Why is this different for you? I don't like either of them. I wouldn't want them both existing legally at the same time. I think there's enough out there with alcohol, cigs, etc. ...and then adding this as well? I want one form of recreation to go and a lesser evil to step up. Personally, I'd rather none of it was legal (alcohol excluded), but that's less realistic.

Presumably because marijuana is commonly consumed in cigarette form. People see a joint and think of a cigarette that impairs judgement in addition to causing lung damage. So it's moving in the wrong direction for those who want to see tobacco go away.So clearly you see cigarettes and marijuana chained together.

I just can't stand the hypocrisy of cigarette laws. The government want you to continue buying them because they want the sin tax on a legal product, but they won't let you use a legal product.

I'm sure that's true to an extent, but I think it's more of a "right hand left hand" situation where we have various lawmakers setting conflicting policies. Law is in the process of catching up to a shift in public attitude toward smoking, and given how entrenched previous sentiments were, there's bound to be some lurching and staggering. People talk about how great compromise is, but as often as not compromise leads to brain-damaged halfway situations like this where nobody is satisfied.
I think it's only a matter of time before enough people get fed up with the silliness and put a stake through its heart, at which point cigarettes will be "compromised" out of existence.

This type of law, espically in the great state of California, is par for the course. Our government and especially those who govern CA are the ultimate in hypocracy. Almost all laws surrounding cigarettes are hypocritical. I don't smoke and I think it is a filthy and disgusting habit. But, I'm really tired of the government, the libs and others treating someone who chooses to smoke like a citizen with no rights. The smoker these days is being segregated just like blacks were before civil rights. And who is going to stand up for the smoker like the civil rights people did in the 60's? Nobody.
